HOW TO MAKE A MECHITZAH
TO SEPARATE THE WATER IN A PIT

(1) The lower the Mechitzah, the more effective it is in separating the
water in one side of the pit from the water in the other side.
(2) This is the opinion of Rav Huna in Eruvin. (Rav Huna and Rav Yehudah
argue about the opinions of the Tana'im. Rashi explains the opinions cited
in our Gemara in accordance with the view of Rav Huna. See Chart for Eruvin
(3) One Tefach of the Mechitzah must reach beneath the surface of the water
as well (as explained by Yakov Karchina'a in Eruvin 86a).
(4) This is the Halachah, according to Rav's opinion that a "hanging
Mechitzah" ("Mechitzah Teluyah") is valid when it is over water (if it was
made for the water).
(5) In our Gemara, the Tana Kama says that the Mechitzah may be made "Bein
mil'Ma'alah, Bein mil'Matah, Bein b'Soch Ogno" -- "either above, below, or
just inside the rim." According to this Girsa, the world "mil'Ma'alah"
(above) must mean that the Tana Kama holds that a Mechitzah works to
separate the water in the pit even when it is built *above* the rim of the
pit, like Rebbi Yehudah says. Tosfos discusses a similar Girsa in which the
Tana Kama says "Bein mil'Ma'alah, Bein mil'Matah mi'Soch Ogno" -- "either
above, or below just beneath the lip of the pit." Tosfos rejects this Girsa
because Rebbi Yehudah seems to be a separate opinion and not agreeing with
the Tana Kama. Furthermore, the word "mil'Ma'alah" as Beis Shamai uses it
certainly means beneath the lip of the pit (but above the water level), as
the Gemara clearly says in Eruvin; it cannot be that the world "mil'Ma'alah"
of the Tana Kama means above the lip of the pit. The correct Girsa of our
Gemara, therefore, is "Bein mil'Matah, Bein b'Soch Ogno" (but not "Bein
mil'Ma'alah"), meaning "either in the lower half of the pit (reaching one
Tefach into the water), or below the lip of the pit (above the level of the
water)." This appears to be the Girsa of Rashi and Tosfos in our Sugya. The
words "Bein mil'Ma'alah" indeed do not appear in the Girsa of the Dikdukei
Sofrim, nor in the Gemara in Eruvin (86a).
